Terms and Conditions

Payments

Payment must be made by the date provided in your confirmation email, the organisers reserve the right to offer your place to an alternative provider if payment is not made.

Cancellations

If you cancel your place three weeks before or less no refund will be issued – except in the case that the organisers can find a suitably similar replacement. If a suitably similar replacement is found you will be provided a refund minus the payment processing fees.

If the event is cancelled one or more days before commencement (29 March) a refund minus payment processing fees will be issued to stallholders.

Wet Weather Policy

Should the event be cancelled due to weather during the official trading hours that are advertised to the public no refunds or credits will be applicable.

Event/Market cancellation is at the sole discretion of the organiser.

Stallholder conduct

Stallholder conduct is an important part of our events. Conduct specifically refers to professional standards, communication and / or cooperation in the spirit of the events – including arrival times, vehicle use, language, hygiene, quality standards, illegal sales, drug and alcohol use, correct and honest labelling, presentation, well maintained and safe equipment, courtesy to others including neighbouring stallholders, attendees, safety officials, and staff members, and a zero tolerance to inappropriate, rude, or intimidating behaviour in the form of spoken, physical or deemed similar actions. We reserve the right to evict any stallholder from the event at any time  for not following stallholder conduct.

Please always be conscious of those around you, observe all safety procedures, and please follow all directions upon arrival, during and following each market. Please report any incidents to one of our team members immediately.

You agree to sell only the items listed in your Expression of Interest application, unless otherwise agreed.

Stallholder Entry and Exit and site management

Unless previously agreed you must bump in between 6:30am-9am on 29 March and remain in place until 8pm on 29 March 2024.

Exit time is between 8-10pm on 29 March. No packing down during official market hours. All gazebos and gear must be packed down before bringing vehicle on-site.

Please do not move your vehicle until customers have vacated.

You agree to follow the directions of security and event staff regarding bump in and bump out times, stall location and accessing the site.

Stallholder Parking

Stallholder parking is available offsite around the market area. Stallholders must park at least two blocks away from the nearest event boundary. Please refer to the site map for clarification.

No Stallholder is allowed to park within the market area unless prior approval has been given. Parking is available free of charge.

Please be aware that we cannot be made liable for any parking fines.

Insurance Requirements: 

All stallholders must supply their own Public and Product Liability Insurance, to a minimum of $20 Million in Coverage. Current copies or your Public Liability (covering the event period) need to be provided at least three weeks before the event (unless otherwise agreed). If these documents are not provided we reserve the right to cancel your position with no refund.

Special Requirements for Food and Beverage Stalls

All Food Stalls need to have a Groundsheet on the floor of their stall to prevent staining. This is a condition of attendance and trading.

All Coffee Stalls need to remove any rubbish and left-over coffee grounds, before leaving the site.

Rubbish

Each stallholder is responsible for removing their own rubbish at the end of the event Rubbish must not be left on site, nor placed in event or council rubbish bins.

Bins provided are for customer use only. Commercial waste must not be placed in these bins.

Damages

Any damage found to equipment, landscaping, lighting, lessor’s (property owners) and/or market owner’s property will be charged to the individual responsible.

Power

Power will not be provided, stall holders need to provide their own power.

Wind Weights

Wind weights are required on all legs of all gazebos. This is a condition of trade.

Exclusion of Liability 

To the maximum extent permitted by law, we exclude and are released from any liability to you and your employees, agents, contractors and invitees, whether in contract, tort, statute or any other way, for any personal or financial injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by you, your employees, agents, contractors, invitees and/or any other person, or for any costs, charges or expenses incurred by you, arising from or in connection with your occupancy of the Stall, unless caused by (and only to the extent of) our wilful misconduct, negligence or breach of a statutory duty or warranty.

Indemnity 

You are liable for and indemnify us and our officers from and against any claim or action (whether in contract, tort, statute or otherwise, including for negligence), liability, loss, damage, costs (including but not limited to, legal costs on a full indemnity basis), charges and expenses arising from or in connection with your occupancy of the Stall, including, without limitation, loss of or damage to property, or personal injury or death of any person.

This indemnity is independent from your other obligations under these Terms and Conditions and will continue while you are a Stallholder and after you have ceased to be a Stallholder. We may enforce this indemnity before incurring expense.
